Statute of Limitations for Civil Cases:
- There is a 8 year Statute of Limitations for child sexual abuse after the victim’s 18th birthday or 3 years after reasonable discovery. Wyo. Stat. §1-3-105(b) “…discovery” has been defined as the moment the victim discovered or reasonably should have discovered that the psychic trauma was caused by the sex abuse, regardless of when the sex abuse actually occurred. See McCreary v. Weast, 971 P.2d 974 (Wyo. 1999)
Statute of Limitations for Criminal Cases:
- There no Statute of Limitations for any sex abuse criminal prosecution. See Boggs v. State, 484 P.2d 711 (Wyo. 1971).
