A Virginia Beach Sunday School teaching assistant has been charged with thirteen ]counts of sex abuse. Shea Huffman was arrested when a young child informed authorities that he was sexually abused by the assistant for over a year. The church sex abuse occurred at the Calvary Assembly of God. Clergy abuse, minister sex abuse and church sex abuse are disturbing crimes, and in most cases, there is a set period of time for the priest abuse victims to file suit, but that applies to all child sex abuse victims.

It’s about time too. In February of 2011 the Virginia Senate proposed a bill to extend the Statute of Limitations so that child sexual abuse and church sex abuse victims could file civil suits against sex abusers. The sex abuse law limits the period to 2 years to file a sex abuse suit after the victim’s 18th birthday. The proposed new sex abuse law would allow child sex abuse victims 20 years from the victim’s 18th birthday, or 20 years from the date that the victim remembered that they were abused. . http://reform-network.net/?p=8829

Statute of Limitations for Civil Cases:

  • There is a 2 year Statute of Limitations for most child sexual abuse personal injury cases after the cause of action accrues. Va. Code Ann. § 8.01-243 (2003) There is also a 2 year Statute of Limitations from removal of disability, including legal incapacity and minority age status. § 8.01-229 (2003).
  • There is a 2 year limitation period. This period will run from removal of disability, or when the causality of the injury is connected to the sex abuse and is then first communicated to the victim by a licensed psychologist or clinical psychologist. § 8.01-249 (2003).

Statute of Limitations for Criminal Cases:

There is no Statute of Limitations for felonious sexual abuse itself. No SOL for any felony : See Va. Code Ann. § 19.2-8 (2003) Non-felonious offenses can be subjected to time limitations.
